Terms and Conditions
CONDITIONS OF ENTRY FOR PREMMIE MARATHON CHALLENGE
1. OverviewThe Premmie Marathon Challenge (“Challenge”) is a virtual fundraising event organised by Running for Premature Babies Foundation Limited (ABN 66 618 841 768) (“RFPB”, “we”, “us”).
By registering for or participating in the Challenge, you agree to be bound by these Terms and Conditions.
2. Event Format
The Challenge is a virtual event that allows participants to complete a nominated distance within the event period, using a method and location of their choosing.
Participants are responsible for:
- tracking their own distance or activity
- ensuring all entries are accurate and truthful
- complying with any event rules or guidelines communicated by RFPB
RFPB does not guarantee the accuracy of any activity tracking, leaderboards or associated technology.
3. Eligibility
By registering, you confirm that:
- you are at least 18 years of age, or have parental or guardian consent
- your participation is voluntary
- you may withdraw from the Challenge at any time
4. Health and Safety
You acknowledge that:
- participation involves physical activity that carries inherent risks
- you are responsible for assessing your fitness to participate
- you should seek medical advice if unsure of your ability to participate
You agree:
- to participate safely and within your personal limits
- to comply with all applicable laws, public health orders and safety requirements
- not to participate if you are unwell or injured
RFPB does not provide medical support or supervision.
5. Participation at Your Own Risk
You participate in the Challenge entirely at your own risk.
To the maximum extent permitted by law, you:
- accept all risks associated with participation, including injury, illness, loss or damage
- waive and release RFPB and its officers, employees, volunteers, sponsors and partners from any liability arising from your participation
Nothing in these Terms excludes any rights that cannot be excluded under Australian law.
6. Indemnity
You agree to indemnify and hold harmless RFPB and related parties from any claims, losses, damages or expenses arising from:
- your participation in the Challenge
- your breach of these Terms
- any act or omission by you
7. Fundraising
By registering, you may choose to fundraise for RFPB.
If you fundraise, you agree that:
- all donations must be made through your official fundraising page or approved platforms
- you will not collect donations in a personal bank account or hold funds on behalf of RFPB
- all funds raised are donations to RFPB and are not refundable to you
- platform or transaction fees may apply
RFPB reserves the right to:
- suspend or close fundraising pages
- remove inappropriate content or activity
- set or update fundraising targets or requirements
8. Legal Compliance
You agree to comply with all applicable laws when fundraising, including:
- fundraising legislation in your State or Territory
- any laws applicable in the country where you are fundraising
You are responsible for understanding your legal obligations.
9. Use of Technology and Third Parties
The Challenge may use third‑party platforms and services, including:
- fundraising platforms
- payment processors
- fitness tracking or mobile applications
Running for Premature Babies:
- does not control these third parties
- is not responsible for errors, outages, fees or data handling by them
- does not guarantee uninterrupted or error‑free service
Use of these services is at your own risk and subject to their terms.
10. Content and Intellectual Property
If you upload or share content (including photos, videos or text), you confirm that:
- you own or have the right to use the content
- the content does not infringe any third‑party rights
You grant RFPB a perpetual, worldwide, royalty‑free, irrevocable and transferable licence to use, reproduce, modify and publish your content for marketing and promotional purposes.
You agree to indemnify RFPB against any claims arising from your content.
11. Image and Marketing Consent
You consent to RFPB using:
- your name
- your image or likeness
- any content you provide
for promotional, marketing and fundraising purposes, without compensation.
You may receive communications from RFPB by email, SMS or other channels. You can opt out at any time.
12. Privacy
RFPB collects and handles personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.
Your information may be used to:
- administer the Challenge
- process donations
- communicate with you about the event and future initiatives
You can opt out of marketing communications at any time.

13. Event Changes and Cancellation
RFPB may, at its discretion:
- change the format, rules or timing of the Challenge
- postpone or cancel the Challenge
RFPB is not liable for any loss arising from such changes.
14. Insurance
RFPB does not provide insurance cover for participants.
You are responsible for arranging any personal insurance you consider appropriate.
15. Account Closure
RFPB may close fundraising pages after the Challenge has ended, including after a defined post‑event period.
Donations received after this time may still be accepted at RFPB’s discretion.
16. Website Use
Use of the Challenge website and associated content is at your own risk.
RFPB does not guarantee:
- accuracy or completeness of content
- uninterrupted access
- error‑free operation
17. Governing Law
These Terms are governed by the laws of New South Wales, Australia.
18. Acceptance
By participating in the Challenge, you confirm that you have read, understood and agree to these Terms and Conditions.
